⚠️ Scotland Has Different Property and Tenancy Law
Private Residential Tenancy (PRT): Scotland uses the Private Residential Tenancy, not the Assured Shorthold Tenancy used in England. PRTs have no fixed term — they are open-ended. This significantly affects your ability to end a tenancy. You cannot use Section 21 (no-fault eviction) — Scotland does not have this. Notice periods: Tenants must give 28 days’ notice to leave. Landlords must give 28 days’ notice for tenancies under 6 months, or 84 days for longer tenancies — plus prove a valid ground under the Act.
Rent control: Scotland introduced rent control measures in 2022. Check current regulations at mygov.scot before setting rents — the regulatory position has continued to evolve.
Scottish Landlord Registration: All landlords (including R2R operators as sub-landlords) must be registered with the local council via the Scottish Landlord Register before any tenancy begins. Operating without registration is a criminal offence.
